Terms of Service

These terms apply to this website and to Widget Weasel LLC’s subscription website service. If you become a client, the documents that actually govern the work are the Master Client Service Agreement and the Order Form you sign. This page is a plain-English summary of them for people deciding whether to get in touch. Where this page and those documents differ, those documents control.
What Widget Weasel does
Widget Weasel designs, builds, hosts, secures, and maintains websites for local businesses under a monthly subscription. What is included at each price, and any add-ons, are listed on the rate sheet attached to your Order Form.
Billing, term, and cancellation
Subscriptions are billed monthly in advance to the payment method on file, at the price shown on your Order Form. There is a receipt after every charge, and at least 30 days’ notice before any price change.
The 12-month plan runs for twelve months and then continues month to month at the same base price until you cancel. It does not renew into a new fixed term. The month-to-month plan has no fixed term.
You can cancel at any time by emailing the address on your Order Form. Cancellation takes effect 30 days after that notice is received. If you cancel during the 12-month plan, an early exit fee applies, equal to the lesser of the flat figure on your rate sheet or the monthly fees remaining in your term, so it can never exceed what finishing the term would have cost. There is no early exit fee on the month-to-month plan, because that plan pays its setup fee at signing instead. One fee, two possible moments, never both.
When you leave: your domain transfers to your control, your finished site is delivered to you, a 30-day transition period runs, and hosting then ends.
What you own, and what Widget Weasel keeps
Your domain, your content, your logo, your photographs, and your Google Business Profile are yours throughout and stay yours when you leave. You are responsible for having the rights to the content you supply.
On cancellation you receive the finished site as served, the HTML, CSS, and images, plus a license to run it for your own business. Widget Weasel keeps its own build tooling, source templates, shared components, and design system, which are not part of the site you receive. The license passes through the terms of any third-party fonts, stock images, or plugins involved, because those are not Widget Weasel’s to grant.
Third-party services
Widget Weasel integrates third-party platforms at your request, such as online ordering, booking, email, and payment providers. Those services are governed by their own terms, and their fees and their uptime are their responsibility. Widget Weasel connects them and does not operate them, and their fees are paid by you to them directly.
Your site visitors’ data
You are the data controller for the personal information your site’s visitors submit. Widget Weasel and any form processor act as service providers. Maintaining an accurate privacy policy on your site, and your own data-law compliance, are yours. A privacy policy is supplied with every site as a convenience and as a starting point; keeping it true as your business changes is your responsibility.
No guarantees, and accessibility
Widget Weasel makes no guarantee of search rankings, traffic, revenue, or any business outcome. Anyone who guarantees you a ranking is guessing.
Widget Weasel builds to modern standards and to the WCAG accessibility guidelines as a matter of practice, and every site carries an accessibility statement page with a contact for reporting problems, which are then remediated promptly. That is a description of real practice and not a warranty: Widget Weasel offers no warranty of ADA or other legal compliance, does not provide legal advice, and never represents that any website is “ADA compliant” or lawsuit-proof. Each business remains responsible for its own legal and accessibility obligations, including the accessibility of content it supplies. Widget Weasel’s own statement is on the accessibility page.
Acceptable use
Client sites share hosting infrastructure. Widget Weasel may remove content or suspend a site immediately for unlawful, infringing, malicious, spam, adult, or hateful content, without that being a breach of the agreement, because one site’s violation puts every other client’s site at risk.
Limitation of liability
To the maximum extent permitted by law, Widget Weasel’s total liability for any claim related to its services is limited to the greater of the fees you paid in the three months before the claim or one month’s fee at your tier, and for a client with no monthly fee, $99. Widget Weasel is not liable for consequential, incidental, special, or indirect damages, or for lost profits or lost data. These limits do not apply to fraud, to bodily injury or property damage caused by wilful misconduct, to your payment obligations, or to the indemnities in the agreement, to the extent South Carolina law does not permit them to be limited.
Governing law
These terms and the client agreement are governed by the laws of the State of South Carolina, without regard to its conflict-of-laws rules.
